Member-Firm performs Phase I and preliminary geotechnical engineering design study for a major retailer on a site previously occupied by industrial laundry. In addition to the proposal, the project engineer also submitted estimated cost for remediation of contaminated site. When the actual cost of removing the contaminated soil ended over 2 million dollars, the client sued, but because of Limitation of Liability clause, the member firm somewhat avoided larger amount in penalty, but still had to pay in legal fees.
